These Terms & Conditions and Privacy Policy (the “Terms”) govern the use of the website phoenixwebdigital.com (the “Site”) and the services provided by Phoenix Web Digital. By browsing the Site or using our services, you acknowledge that you have read, understood and accepted these Terms in full.

2. Purpose and Acceptance

The purpose of the Site is to present the activity, services and portfolio of Phoenix Web Digital, an agency specializing in website creation and redesign, automation, search engine optimization (SEO) and maintenance. The Site is a showcase website: no sale or payment is processed directly online. Every request leads to a prior discussion and a personalized quote.

Using the Site implies full acceptance of these Terms. If you do not accept these Terms, please do not use the Site.

3. Conditions of Use of the Site

Users agree to use the Site in accordance with the law and these Terms. It is notably prohibited to:

• impair the operation, security or integrity of the Site;
• attempt unauthorized access to the Site’s systems or data;
• collect other users’ data without their consent;
• submit unlawful, defamatory or otherwise objectionable content through the Site’s forms.

Phoenix Web Digital strives to keep the Site available 24/7 but cannot be held liable for any interruption, whether temporary or permanent, due to maintenance, technical failure, network issues or force majeure.

4. Terms of Service

Phoenix Web Digital’s services are subject to a prior quote detailing their scope, price and timeline.

4.1 Quote and order

Each quote is valid for the period stated therein. An order is deemed firm once the client validates the quote in writing (signature, confirmation e-mail or payment of a deposit).

4.2 Prices and payment

Prices are stated in shekels (₪) or in the currency indicated on the quote. As an Authorized Dealer (Ossek Mourché), Phoenix Web Digital charges Israeli VAT (מע”מ) at the applicable rate where relevant. Payment terms and milestones (deposit, interim payments, balance) are specified in the quote. Late payment may result in the suspension of ongoing services.

4.3 Timelines and delivery

Any timeline provided is indicative and depends in particular on the client supplying the required materials (content, texts, images, access, approvals). The client agrees to collaborate actively and provide these materials within reasonable timeframes.

4.4 Revisions and approval

The number of revision cycles included is specified in the quote. Any request outside the initial scope may be subject to an additional quote. Final delivery constitutes acceptance of the work; failing any written reservation within a reasonable period, the service is deemed accepted.

4.5 Provider’s obligations

Phoenix Web Digital undertakes to perform its services professionally, in accordance with industry standards and the objectives agreed with the client. This is an obligation of means and not of result, particularly regarding SEO and performance, which depend on external factors (search engines, competition, user behavior).

5. Intellectual Property

All elements of the Site (structure, texts, logos, graphics, images, videos, code) are protected by intellectual property law and remain the property of Phoenix Web Digital or its partners. Any reproduction, representation, modification or exploitation, in whole or in part, without prior written authorization, is prohibited.

Regarding deliverables provided to clients, the transfer of rights takes place after full payment, under the conditions set out in the quote. Tools, software components, methods and know-how proprietary to Phoenix Web Digital remain its property.

6. Liability

Information published on the Site is provided for guidance only and may be modified at any time. Phoenix Web Digital cannot be held liable for any direct or indirect damage resulting from access to the Site, its use or the inability to access it, nor for the use made of the information it contains.

7. Hyperlinks

The Site may contain links to third-party websites. Phoenix Web Digital has no control over these sites and disclaims any responsibility for their content, practices or privacy policies. Access to such third-party sites is at the user’s sole risk.

8. Privacy Policy

Phoenix Web Digital attaches great importance to the protection of your personal data, in accordance with the Israeli Protection of Privacy Law (חוק הגנת הפרטיות, 5741-1981) and its regulations.

We collect the data you voluntarily provide, in particular through the contact / quote request form and via WhatsApp: full name, e-mail address, phone number, and the subject and content of your request. Technical data may also be collected automatically (IP address, browser type, pages visited) for statistical and security purposes.

8.2 Purposes and basis of processing

Your data is used to: respond to your requests and prepare quotes, manage the business relationship, improve our services and the Site, and comply with our legal obligations. Processing is based on your consent and/or on the performance of pre-contractual and contractual measures.
